A planning refusal for a static caravan in Kildonan has been overturned on appeal by the Local Review Body.
The body, comprising 12 North Ayrshire councillors, approved the siting of a caravan for an agricultural worker at JJ Market Garden in High Kildonan at a special meeting in Cunninghame House on Tuesday afternoon.
There are three conditions attached to the approval; namely that the caravan shall be occupied solely in connection with the cultivation of crops and the supervision of crops and livestock, that permission shall last for three years after which it shall be permanently removed unless an extension had been granted, and that approved parking and turning arrangements shall be implemented.
In a statement to the body the applicants said: ‘We contest the planning officers opinion that the enterprise is not a going concern requiring full time occupation by the applicants.
‘The applicants wish to dispel the implied impression that this application is just a convenient scheme to site a caravan on their land with no regard to the future development of the market garden.’
A letter of support from Jackson Carlaw MSP stated: ‘This has all been very distressing for my constituents. They are doing their best in the most difficult of times to make a living on the isle producing products for local consumption.’
Previous applications on the site were for the change of use of agricultural land to form retail market garden and siting of caravan (retrospective) refused on January 16, 2006, erection of an agricultural shed, approved on March 27, 2006, and siting of a temporary touring caravan approved on appeal on January 9, 2008.
After Tuesday’s meeting an NAC spokesperson said: ‘The Review Body agreed to overturn the decision of the planning officer and approved the application with three conditions.’
